Can occupational diseases detected after the dissolution of labor relations be regarded as work-related injuries?
Case
Luo was engaged in contour machining in a metal product company and was subjected to prolonged exposure to quartz dust. The metal product company did not renew the labor contract with Luo which expired in January 2014 due to the adjustment of its production and business scope. So the labor relations between the two sides was rescinded. Later Luo went back to hometown and had been engaged in agriculture from then on.
In April 2016, Luo was hospitalized in a prevention and treatment center for occupational diseases due to physical discomfort, and was diagnosed as having the tertiary silicosis by this hospital in May 2016.
