Shall the employer still give severance pay if labor protection has been provided
Introduction to Case
On February 24, 2008, Zhang joined the company and engaged in noise exposure work. To protect employees’ health, the company took such measures as wrapping noisy equipment with sound insulation covers and installing sound insulation boards in operating rooms, and also provided employees with protective articles such as noise proof earplugs. The aforesaid sound insulation and protective equipment (articles) met the quality standards and protection requirements. Furthermore, the company arranged physical examination for employees every year. On May 15, 2019, Zhang was diagnosed as having slight occupational noise-induced hearing loss by an occupational disease diagnosis and appraisal committee, and the company immediately transferred Zhang from the noise exposure position.
