与之前公布的征求意见稿相比,《司法解释(四)》有很大变化,如"约定管辖"未能引入劳动纠纷的处理、"末位淘汰"能否认定为非法解除未予明确、竞业限制变动大等。
Compared to the draft previously released and soliciting comments, the Interpretation has made important changes. For example, the Interpretation does not cover "agreement on jurisdiction " on labor disputes, and does not specify whether "the final elimination principle" will be considered as illegal termination and that there are material changes made to non-competition provisions.
