How to deal with the resignation of employee with suspected occupational disease?

从事接触职业病危害作业的劳动者未进行离岗前职业健康检查，或者疑似职业病病人在诊断或者医学观察期间，用人单位不得依医疗期满或经济性裁员等规定而与其解除劳动合同。

If the employee is engaging in operations exposing him to occupational disease hazards and has not undergone an occupational health check-up before he leaves his position, or is suspected of having an occupational disease and isunder diagnosis or medical observation, the employer shall not dissolve the labor contract with the employee under regulations on expiration of period for medical treatment or economic layoff.
