发生劳动仲裁的案件时一定要对是否会出现“一裁终局”的情形做出预估，预估到可能会发生“一裁终局”结果的，一定要在劳动仲裁阶段做好充分的思想准备和证据准备。

Employing units should fully estimate situations whether the labor dispute is applicable to the "final and binding of arbitration award". They should be well prepared and collect all evidences during the labor arbitration period.

A New Interpretation of the Finality of Arbitration

对用人单位而言，一裁终局的裁决书一旦作出后，立即发生法律效力，其无权直接向人民法院起诉;但是，劳动者一方仍然有权在指定的起诉期间内依法向法院提起诉讼。

For employing units, the arbitration award will be effective once issued. And the employing unit should not file the lawsuit to the people’s court again. However, the employee can file the lawsuit to the people’s court within the designated prosecution period.
