为了避免对值班的认定产生争议，最好由用人单位明文规定，或与劳动者在集体合同、劳动合同中约定。

For the avoidance of dispute over the identification of work on duty, employer should explicitly specify its definition in employer's regulations or the Collective contract or labor contract with employees.

《规定》也不是完美的，虽然明确了诸多问题，但对派遣比例严格限制在10%，且无过渡期，这似乎没有考虑到实际操作的可行性，极有可能引发群体性事件。

The Rule is not perfect, although it specifies above mentioned questions, it strictly restricts the percentage of labor dispatch to 10% and no transition period is allowed. This seems not having considered the practicability and easy to cause Collective events.

编者按：新一轮"加薪潮"似乎已经到来。政策层面上，最低工资调整、集体协商推进、支付保障制度建设、收入分配制度改革；企业层面上，从深圳富士康员工跳楼，到南海本田工人罢工，再到全国各地罢工潮的风起云涌，长期以来的"资强劳弱"格局似乎在悄然转变。加薪时代来临了吗？人口红利结束了吗？中国的"刘易斯拐点"是否出现？制造业当何去何从？

Editor's note: The new round of "pay raises" seems to have come, as evidenced by policies on adjusting minimum wage rates, promoting a Collective negotiation system on wages, establishing a wage payment guarantee system, and reforming the income distribution system; this is evidenced by such corporate incidents as the suicide of Foxconn employees, the strike by Honda workers in Nanhai, and a wave of similar strikes across China. The long-standing environment of "strong capital and weak labor" seems to be changing. Has the era of pay raises come? Has the demographic dividend ended? Will the Lewis Turning-Point come up in China? What should the manufacturing industry be heading for?
