The latest labor dispute trial criteria of Shanghai

对于用人单位来说,切不可单纯认为有其他单位为劳动者缴纳社保或代为办理用工登记,自己就不可能成为劳动法意义上的用人单位,对于劳动关系确难以界定的人员,建议至少签订书面劳务协议,以明确双方之间法律关系的性质。

Companies should not simply believe that they are not the employing unit in the labor law sense as long as some other units are paying social insurances or handling employment registration formalities for the workers. For workers whose labor relations are hard to define, companies are advised to sign a written labor agreement, to clarify the nature of legal relations between the two parties.

  • 四部委发文:少裁员企业可申领“稳岗补贴”

    Jointly released notice by four ministries: “employment stabilizing allowance” to encourage less downsizing

    人社部、财政部、发改委、工信部近日联合发布的《关于失业保险支持企业稳定岗位有关问题的通知》明确,今后,企业在调整优化结构中不裁员或少裁员,将获得由失业保险基金给予的稳定岗位补贴。该政策将执行到2020年底。

    According to Notice on Issues Regarding Unemployment Insurance for Enterprise Headcount Stabilization jointly released by Ministry of Human Resources and Social Security, Ministry of Finance, Development and Reform Commission as well as Ministry of Industry and Information Technology, starting from the date of notice, enterprises with no or little downsizing during restructuring will be granted employment stabilizing allowance from Unemployment Insurance Fund. The policy will be valid through the end of 2020.

    Four charge reduction measures by State Council

    国务院总理李克强近日主持召开国务院常务会议,决定从明年1月1日起实施四项具体降费措施,每年将减轻企业和个人负担400多亿元。其中对小微企业免征组织机构代码证书费等42项行政事业性收费。

    In the recent executive conference of State Council hosted by Premiere Li Keqiang, it was decided that four charge reduction measures will start to take effect on January 1 next year, reducing more than 40 billion yuan per year for both enterprises and individuals. The measures include exempting 42 administrative fees (e.g. fee for Certificate of Organization Code) for small and micro enterprises.

    Guangdong: linking childbirth allowance with salaries

    新修订的《广东省职工生育保险规定》从2015年1月1日起施行。新规改变了此前都按照社会平均工资作为基数的方式,变为与本单位工资挂钩。工资高于社会平均工资的单位,生育津贴将更高。工资低于社会平均工资的单位,生育津贴也会相应降低。

    The recently amended Rules Regarding Employee Childbirth Insurance in Guangdong Province will take effect from January 1, 2015. According to the new rules, the base for childbirth insurance will no longer be the average social salary, but the actual salary from the hiring organization. Organizations with salaries higher than the social average shall have more childbirth allowance for employees, and vice versa.

    Shanghai releases new Housing Provident Fund policy

    上海市公积金管理中心日前公布了公积金新政:有1套住房并已结清公积金贷款,为改善居住条件再次申请公积金贷款以购买普通商品住房的,参照首套房贷款政策,即首付3成、每户最高贷款限额60万元,有补充公积金的80万元。

    Shanghai Housing Provident Fund Administration Center recently released a new Housing Provident Fund (HPF) policy: households who already own a residential apartment with fully paid HPF loan and wish to once again apply for HPF loan to purchase another common commodity apartment to improve living conditions, are eligible to be granted loans under the same policy with that for the first apartment, i.e. 30% initial payment plus a 600,000 yuan cap loan per household, or a 800,000 yuan cap for households with supplement HPF.

    Fortune releases its 2014’s Top People in Business, where Larry Page, CEO of Google is awarded Businessman of the Year. Tim Cook, Apple’s CEO follows as runner-up. Jack Ma, founder of Alibaba ranks 10th.

    近日发布的一份调查报告显示,外资企业和民营企业雇员对福利满意度相对较高,“比较满意”得分率分别为35.81%和32.95%。而在效果方面,“效果显著”得分最高的是“国企”,为19.57%;其次为“外企”,得分为16.22%。

    According to a recent survey, employees in foreign-invested enterprises and private enterprises are more satisfied with their welfare, where 35.81% and 32.95% respectively vote “satisfied”. In terms of effect of welfare, “state-owned enterprises” scores most in “outstanding effect” with 19.57% votes, followed by “foreign invested enterprises” with 16.22%.

    Southern Talent Market in Guangzhou recently released its 2014-2015 Guangdong Salary Report. Salary growth in Guangdong slows down this year, with an average 4% growth across 318 vocations. Average monthly pay in Shenzhen is 7,261 yuan, ranking first; Guangzhou follows with 6,830 yuan.

    Third-party survey institution MyCOS released its Analysis on 2015 University Graduates’ Job-hunting Expectations, according to which, 70% of university graduates are looking for a job, and 40% wish to enter state-owned enterprises.
