企业年终发放实物的若干法律问题

Certain legal issues on payment in kind at year end

年终,有些企业选择以实物的形式给员工发放奖励。各个企业对发放实物的目的不尽相同,那么从法律上来看,发放实物会存在哪些问题呢?

At year end, some enterprises choose to pay compensation in kind. The purpose of payment in kind is different from enterprise to enterprise. From legal perspective, what kind of issues the payment in kind may cause?

  • 劳动合同法修改

    Labor contract law amendment

    全国人大常委会表决通过了关于修改劳动合同法的决定。修改主要涉及劳务派遣,并将于2013年7月1日起施行。

    The Standing Committee of People’s Congress has passed the resolution on the Amendment To The Labor Contract Law. The Amendment mainly relates to service dispatching and becomes effective on the 1st July 2013.

  • 《深圳经济特区社会养老保险条例》自1月1日起施行

    Social Retirement Insurance Rule of Shenzhen Special Economic Zone effective on the 1st January 2013

    《深圳经济特区社会养老保险条例》自2013年1月1日起施行。新条例将用人单位的缴费比例由10%提至13%。

    Social Retirement Insurance Rule of Shenzhen Special Economic Zone becomes effective on the 1st January 2013. The new Rule increases the payment proportion by employer from 10% to 13%.

  • 上海:公民参与应急救援期间工资待遇和福利不变

    Shanghai: compensation treatments and welfares keep unchanged for citizens participating in emergency rescue

    《上海市实施〈中华人民共和国突发事件应对法〉办法》日前通过,《办法》要求,一旦他人因突发事件发出紧急求助,成年公民都应提供力所能及的帮助,并提出了激励制度:公民参与应急救援期间的工资待遇和福利不变。

    “ Shanghai Implementation Method of ‘Emergency Response Law of People’s Republic of China’” has been resolved. The Method requires that once emergency help is called, all the adult citizens should provide their help as possible as they can. The Method also provides reward system: compensation treatments and welfares keep unchanged for citizens participating in emergency rescue.

  • 北京联动上调6项社保待遇标准

    Beijing increases 6 items of social security treatment standards

    北京市对企业退休人员基本养老金、城乡居民基础养老金和福利养老金、工伤保险定期待遇、企业最低工资标准与失业保险金6项社会保障待遇标准进行调整。新待遇自2013年1月1日起开始执行。

    6 items of social security treatment standards including basic old-age pension of Enterprises’ retired staffs, basic old-age pension and old-age welfare pension of urban and rural citizens, fix term treatment of work-related injury insurance, minimum wage standards of enterprises and unemployment insurance have been adjusted in Beijing. The new treatment becomes effective on the 1st January 2013.

    《广东省促进就业规划(2011—2015年)》日前正式发布。《规划》提出了“十二五”期间的主要就业目标:城镇登记失业率控制在4%以内,最低工资标准年均增长13%以上。

    “Employment Promotion Plan For Year 2011-2015 of Guangdong” was just officially announced. The Plan sets up the main employment targets during the 12th Five Year Plan: Urban registered unemployment rate should be controlled within 4% and the minimum wage shall be increased annually on average by more than 13%.

    一份名为《中国企业员工福利保障指数调研报告》的白皮书称,2012年中国企业员工福利保障指数为65.37,刚过“及格线”。其中,外企福利最好,民企福利最差,国企没有想象的那么好。

    According to an Investigation Report On Welfare and Security Index of Chinese Enterprises’ Staffs, the Welfares and Security Index of Chinese Enterprises’ Staffs for year 2012 is 65.37 which just exceeds the passing line. Amongst which, foreign invested enterprises have the best welfares, private owned enterprises have the worst welfares and state owned enterprises don’t have welfares as good as what have been imagined.

    科锐国际研究中心日前发布的《科锐国际2012企业年终奖调研报告》显示,较之2011年,五成受访企业轻微上调年终奖,一成企业维持不变,但是近四成企业将下调年终奖,而有70%的受访地产企业将上调年终奖,比例最高。

    According to the Investigation Report On Enterprises’ Annual Bonus of Year 2012, just issued by Carrier International Research Center, compared to year 2011, half of the interviewed enterprises slightly increased their annual bonus, 10% of the interviewed enterprises kept their annual bonus unchanged, but around 40% of the interviewed enterprises decreased their annual bonus, and 70% of the interviewed real estate enterprises will increase their annual bonus, which is the highest percentage.
