病假管理问题

Issues concerning sick leave management

员工依法享有休息和休假的权利,员工患病需要休病假的,企业应当允许;企业作为独立的用工主体享有自主用工的权利,应当及时完善自身的病假管理制度。

Employees are entitled to rest and take sick leave according to law. If an employee falls ill and needs a sick leave, the employer shall approve such leave. As an independent entity for labor use, the enterprise shall enjoy the autonomous right of labor use and timely improve its own sick leave management system.

  • 若公司有规定连续旷工三日以上属于严重违纪的情节,且有证据证明该规章制度经过该员工签字签收,则可以在该员工超假不归的第三天后向其确定的通信地址邮寄送达书面的《解除劳动合同通知书》。
  • If the company prescribes that absenteeism for three or more consecutive days constitutes serious disciplinary violation, while there is proof that the employee has received and signed the corporate rules and regulations hereof, then the company can mail the written Notice of Labor Contract Termination to her specified mailing address three days after she did not return to work on time from leaves.

    The State Administration of Taxation revises and issues Tax Deduction and Exemption Management Methods

    国家税务总局近日发布修订后的《税收减免管理办法》,自2015年8月1日起施行。《办法》贯彻落实了国务院行政审批制度改革精神,进一步规范和加强减免税管理工作。

    The State Administration of Taxation recently issued the revised Tax Deduction and Exemption Management Methods, to take effect from August 1, 2015. The Methods implemented the spirits of the State Council’s administrative approval system reform and further standardized and strengthened the tax reduction and exemption management work.

    Non-public medical institutions incorporated into medical insurance designated hospitals

    国务院办公厅日前印发《关于促进社会办医加快发展的若干政策措施》,要求进一步简化社会办医审批手续将,全面清理不合理前置审批事项;纳入医保定点报销,不得将所有制性质作为医保定点的前置性条件。

    The General Office of the State Council recently issued the Several Policy Measures on Promoting Non-Public Medical Institutions to Accelerate Development. The Measures require further simplifying the approval process of non-public medical institutions, comprehensively clearing unreasonable pre-approval items, and incorporating non-public medical institutions into medical insurance designated reimbursement, not allowed to take the ownership nature as the pre-approval condition.

    Shanghai Collective Contract Regulations revised and passed

    上海市日前通过修改《上海市集体合同条例》的决定,今年10月1日起实施。条例明确工资集体协商的内容包括:工资分配制度、工资标准、工资分配形式和工资支付办法;职工年度平均工资水平的调整幅度;奖金、津贴、补贴等分配办法;加班工资以及试用期、病假、事假等期间的工资待遇,等。

    Shanghai recently passed the decision to revise Shanghai Collective Contract Regulations, to come into effect from October 1 this year. The Regulations clearly stipulate that the contents of wage collective consultation include the wage distribution system, wage rates, wage distribution forms, wage payment methods; employees’ annual average wage level adjustment range; the allocation methods of bonuses, allowances, subsidies, etc.; overtime wage and the wage treatment during the probation period, sick leave, personal leave, etc.

    Wang Zhongmin, Vice President of National Council for Social Security Fund, openly expressed the National Council for Social Security Fund recently invested in Ant Financial and this is the first direct investment of the National Council for Social Security Fund, accounting for 5% shares of Ant Financial.

    上海市统计局公布的《2015年本市高校应届毕业生就业情况调查报告之二》显示,有33.3%的受访毕业生择业首选政府机关或行政事业单位,其次为“外资企业”(32.1%)、“国有企业”(22.8%)和“私营企业”(9.5%)。

    Shanghai Municipal Statistics Bureau released the 2015 Shanghai College Graduates Employment Survey Report 2 showing that 33.3% respondent graduates choose government agencies or administrative institutions first, followed by foreign-funded enterprises (32.1%), state-owned enterprises (22.8%) and private enterprises (9.5%).

    The third inspection team of the central government recently reported the special inspection situation to the State Development & Investment Corporation. In 25 “Inspection Lists”, it clearly pointed out that there are 16 lists with the problem of personnel selection and appointment, taking up 64%.

    Data shows that since 2013, 420 administrative and institution fees and governmental funds have been cancelled, stopped, reduced and exempted at the central government level, which can alleviate corporate and individual burden of about RMB92 billion every year.

    Beijing Housing Fund Management Center recently announced that it will adjust the upper limit for the housing provident fund deposit to RMB4,654 from July 1, increasing by RMB484.

    Beijing Human Resources and Social Security Bureau released Beijing corporate salary guideline this year, and the baseline for workers’ average salary growth is 10.5%, with the up line at 16% and the down line at 3.5%.
