Operation guide of enterprise economic layoff

在裁员的过程中,企业多采用一刀切的方式,各种情形一律界定为经济性裁员,一方面造成了员工的动荡,企业本身也面临违法解除的风险。

In the course of layoff, enterprises mostly adopted the form of "one size fits all", i.e., all layoff circumstances are defined as economic layoff, which will give rise to the instability of employees on the one hand and bring a risk to the enterprise that it illegally terminates the labor contract.

  • 依据《劳动合同法》第41条经济性裁员中包括两种优先情形:一种是优先留用规定,二是优先招用被裁减人员。

    National Bureau of Statistics: China’s GDP grows 7.0% year-on-year in Q2

    国家统计局公布数据显示,上半年国内生产总值296868亿元,按可比价格计算,同比增长7.0%。分季度看,一季度同比增长7.0%,二季度增长7.0%。

    The National Bureau of Statistics released the data showing that the GDP amounted to RMB29.6868 trillion in the first half of year, growing by 7.0% year-on-year calculated at comparable prices. In terms of growth by quarters, it grew by 7.0% year-on-year in the first quarter and 7.0% in the second quarter.

    深圳市人力资源和社会保障局透露,2014年12月31日前,已在深圳办理领取基本养老金手续的企业退休人员,可享受本次养老待遇调整,调整后人均养老金达4169元。

    Shenzhen Human Resource and Social Security Bureau revealed that enterprise retirees who have gone through the basic old-age pension drawing procedure in Shenzhen before Dec.31, 2014 can enjoy the pension treatment adjustment this time and the per capita pension after adjustment reaches RMB4,169.

    The upper limit for the deposit base of Guangzhou housing provident fund breaks RMB30,000

    广州住房公积金管理中心透露,广州公积金2015年度(2015年7月至2016年6月)缴存基数上限相应调高至30935元,比上一年度的29040元高出1895元。

    Guangzhou Housing Provident Fund Management Center revealed that the upper limit for the deposit base of Guangzhou housing provident fund is raised to RMB30,935 correspondingly in 2015 (from July 2015 to June 2016), RMB1,895 higher than RMB29,040 of last year.

    Shanghai employers think that the salary for fresh graduates should be RMB4,400

    国家统计局上海调查总队日前公布报告显示,用人单位认为应届生合适的薪酬水平(指月收入,包括奖金、补贴、缴纳四金等税前全部收入)为:大专生3200元、本科生4400元、硕士研究生5900元。

    The Shanghai Survey Office of the National Bureau of Statistics recently released a report showing that employers think the salary level (refer to the monthly income, including the pre-tax gross wages like bonus, subsidy and payment for four insurances) for fresh graduates should be RMB3,200 for junior college students, RMB4,400 for undergraduates and RMB5,900 for postgraduates.

    The 2015 Summer Chinese Employer Demand and White-collar Worker Supply Report newly released by Zhaopin.com showed that the average monthly salary for white-collars is RMB6,320 in China in the second quarter and Beijing tops the monthly salary list by RMB7,873, closely followed by Shanghai and Shenzhen.
