What preparations should be made following the universal two-child policy?

在不久的将来,国家及各省市层面将展开有关二胎生育待遇的法律法规的修订活动。HR们应当密切关注国家及当地法律法规的修订活动,及时调整企业内部相关规章制度,避免与国家及地方法律法规内容相冲突,确保企业用工的合法、合规性。

In the near future, the amendments will be made to laws and regulations regarding the treatment for birth of a second child at the national and provincial or municipal levels. HR personnel should pay close attention to the amendment to the national and local laws and regulations, and adjust relevant internal rules and regulations in a timely manner, in order to avoid conflict with the national and local laws and regulations and to ensure the compliance of labor employment with the laws and regulations.

  • 人社部:全面实行农民工实名制 严查拖欠工资

    Ministry of Human Resources and Social Security: Comprehensively Implementing Real-Name System for Migrant Workers and Cracking Down on Cases of Wage Arrears

    国务院办公厅日前印发了《关于全面治理拖欠农民工工资问题的意见》,人力资源社会保障部副部长邱小平就相关问题作出解释称,按照《意见》要求,全面实行农民工实名制管理制度,严厉查处拖欠工资行为,努力实现到2020年基本无拖欠的目标。

    The General Office of the State Council recently issued the “Opinions on Overall Settlement of Wage Arrears for Rural Migrant Workers”. Qiu Xiaoping – the Deputy Minister of Human Resources and Social Security made explanations for the relevant issue that, in accordance with the “Opinions”, efforts would be made to fully implement the real-name system for migrant workers, severely investigate and treat the cases of wage arrears, and strive to achieve the target of basically no wage arrears by 2020.

    国家统计局公布的2015年数据显示,60周岁及以上人口2.22亿人,占总人口的16.1%;65岁及以上人口近1.44亿人,占10.5%。

    The data for 2015 released by the National Bureau of Statistics shows that there are 222 million people aged 60 and above, accounting for 16.1% of the total population; and nearly 144 million people aged 65 and above, accounting for 10.5%.

    《广东省工资支付条例修正案(草案)》日前提交审议。修正案规范了工资支付周期,要求用人单位约定的工资支付日期不得晚于工资支付周期届满后15日。

    The “Amendment for Guangdong Provincial Wage Payment Regulations (Draft)” has recently been submitted for consideration. The Amendment prescribes the wage payment period, and requires that the wage payment date stipulated by the employer should not be later than the expiry date of the wage payment period by 15 days.

    根据上海相关法规,该市发布台风、暴雨、暴雪、道路结冰等气象灾害红色预警时,职工因气象灾害红色预警造成误工的,用人单位不得作迟到、缺勤处理。

    According to relevant Shanghai laws and regulations, employers should not count employees for lateness or absence from work if the loss of working time is caused by the red alert for meteorological disasters as issued by the city authorities such as typhoon, rainstorm, blizzard, or icy roads.

    A survey conducted by a well-known HR agency shows that 60% of employers in China intend to raise salary by upwards of 6% in 2016, while 63% of employers in Japan plan to increase salary by less than 3%. A majority of employers in Hong Kong SAR of China, Singapore and Malaysia intend to make a salary increase of 3%-6%.

    中国青年报社会调查中心日前的一项调查显示,2015年超过半数员工年终奖不足5000元,超过4成受访者表示年终奖比去年缩水,还有16.8%直言今年没有年终奖。

    A survey recently made by China Youth Daily Social Survey Center shows that a simple majority of employees have a year-end bonus of less than RMB 5,000 in 2015, and more than 40% of respondents say that the year-end bonus is down on the previous year, and 16.8% frankly expressed that there is no year-end bonus at all.
