公司遇“客观情况”,如何协商变更?

In case of encountering “objective situations”, how should an employer do to change contents of labor contract through consultation?

企业客观情况发生重大变化的,用人单位可以首先与员工协商变更,员工不同意变更内容的,企业可以单方解除劳动合同,但仍须支付法定经济补偿金。

If any significant change occurs to the objective situation of an employer, the employer may negotiate with its employee about changing the contents of his/her labor contract firstly, and if the employee rejects the change, the enterprise may terminate the labor contract concerned, provided that it shall pay legal economic compensation to such employee.

    3月28日,中国政府网发布消息称,《全国社会保障基金条例》已经2016年2月3日国务院第122次常务会议通过,自2016年5月1日起施行。《条例》共分五章三十条,涉及全国社会保障基金的管理运营、监督、法律责任等各方面内容。

    On March 28, it was announced on the website of the Chinese government that the 122th executive meeting of the State Council adopted on February 3, 2016 the “National Regulations on Social Security Fund” which should enter into force as from May 1, 2016. The Regulations, consisting of thirty articles in five chapters, cover the management and operation, supervision and legal responsibility, etc. regarding National Social Security Fund.

    The governments of at least 16 provinces and municipalities directly under the central government have revised their respective regulations on family planning. These 16 provinces include Beijing, Tianjin, Shandong, Shanghai, Zhejiang, Anhui, Jiangxi, Fujian, Guangdong, Guangxi, Hubei, Shanxi, Ningxia, Sichuan, Liaoning, and Qinghai of the provinces, Shanxi has the longest marriage leave, with 30 days; the maternity leave in Beijing lasts up to seven months; Guangxi and Ningxia boast longest paternity leave, with 25 days.

    从深圳市社保局获悉,生育保险津贴申领系统近日正式上线,生育津贴统一由用人单位领取。用人单位未将生育津贴足额支付给职工的,逾期不改正的,将面临2000元以上2万元以下的罚款。

    According to Shenzhen Bureau of Social Security, the system for application for maternity insurance benefits has come on stream recently. The employers are responsible for collecting maternity benefits. If the employers fail to pay in full maternity benefits to employees, and corrective measures are not taken within a designated period, a fine of more than RMB 2,000 but less than RMB 20,000 will be imposed.

    央行金融研究所所长姚余栋表示,个人所得税主要功能是调节收入分配。应提高起征点,增加抵扣项目,照顾中低收入群体。我国已五年没有调3500元个税起征点了,工资水平不断上涨,应至少提高到5000元。

    Yao Yudong, director of Central Bank’s Financial Research Institute, said that personal income tax was chiefly aimed at regulating the distribution of income. The threshold should be raised, and the deductible items shall be added to show preference for low-income groups. The tax threshold of RMB 3500 for personal income tax has not been adjusted for five years. With the rise of wages, the threshold shall be increased to at least RMB 5,000.

    According to the annual report of China National Petroleum Corporation (CNPC), the per capita income of CNPC employees in 2015 was RMB 130,000, down by RMB 10,000 over the previous year. Moreover, CNPC has made a collective pay cut of 15%-20% last year, and the leadership took the lead in the collective pay cut, with a reduction rate of up to 35%.
