公司解散清算过程中员工劳动关系处理解析

Solutions for Employment Relation during Corporate Dissolution/Liquidation

在解散清算的过程中,劳动关系的处理、对员工的安置和补偿是清算工作的重要组成部分。现在笔者就有关法律问题进行分析探讨。

Employment relation settlement, employee placement and severance pay constitute an important part of the work of corporate dissolution and liquidation and what the shareholders and the liquidation group concern most. Now I analyze and study on relevant legal issues as below.

  • 公司解散,经济补偿金的计算
  • Calculation of Severance in Corporate Dissolution
  • 理论上,公司解散情形下的劳动合同终止,公司在计算员工经济补偿金时无需将《劳动合同法》生效之前的员工工龄计算进去。
  • In theory, in the event that the employment contract ends due to corporate dissolution, the company is not required to include the employee’s seniority prior to the effective date of the Employment Contract Law at the calculation of severance pay.

    日前,安徽省政府公布发挥新消费引领作用加快形成新供给新动力的实施意见,推进供给侧结构性改革,使供给体系更加适应需求结构变化。其中,将落实职工带薪休假制度,鼓励有条件的地区和单位实行方便外出休闲度假的弹性作息制度。

    Recently, the Anhui provincial government announced the suggestions of playing the leading role of new consumption to accelerate the formation of new supply and new impetus, and promote the supply-side structural reforms, so that the supply system is more suited to the changes of demand structure. Of the measures, the paid leave system for employees will be implemented and the qualified areas and employers are encouraged to carry out the flexible work schedule which is conducive to the leisure and holidays.

    广州出台了《广州市高层次金融人才支持项目实施办法(修订)》。这个修订后的新办法规定,新引进的金融人才最高可获100万元安家补贴,同时通过降低申报门槛、提高补贴标准等方式释放更大诚意“留才”。

    The Guangzhou government unveiled the “Implementation measures of Guangzhou for supporting project for high-level financial professionals (amendment).” Pursuant to the revised regulations, new financial talents are entitled to the household subsidy amounting to 1 million yuan, while the government shows more sincerity to “retain talent” by lowering the eligibility threshold and raising the subsidy levels, etc.

    Average monthly salary of Shanghai post-90s grass-roots white-collar workers ranks top in China

    数据显示,90后已经成为全国重点城市基层白领的主力,其平均月薪为3918元,月薪超过5000的高收入群体占比为13.55%。其中,上海地区小白领平均月薪达到5980元,居全国首位,北京5570元,位居第二。

    Data shows that the post-90s have become the backbone of grass-roots white-collar workers in major cities, with an average monthly salary of 3918 yuan. The high-income section with a monthly salary upwards of 5,000 yuan accounts for 13.55%. Of whom, the average monthly salary of post-90s white-collar workers in Shanghai reach 5980 yuan, ranking top in China, followed by those Beijing with a salary of 5570 yuan.

    当地时间2016年5月5日,美国纽约,来自美国最大电信运营商威瑞森公司(Verizon)的2000名员工持续罢工,沿华尔街游行,因未能与管理层就新的劳动合同达成协议。

    On May 5, 2016 local time in New York, 2000 employees from the US’s largest telecom operator Verizon continued the strike and marched along the Wall Street due to the failure of agreeing on a new labor contract with the management.

    美国智库经济政策研究所日前发布研究结果显示,美国顶级公司首席执行官(CEO)薪酬可超其员工300倍。绝大多数CEO不会为公司业务波动造成的损失负责。

    The results of study recently published by the American think tank Economic Policy Institute showed that the remuneration of chief executive officer (CEO) at top America’s companies can exceed 300 times that of their employees. A great majority of CEOs are not responsible for loss caused by fluctuations in business.

    人社部、财政部近日下发通知称,2016年各级财政对居民医保的补助标准在2015年的基础上提高40元,达到每人每年420元。

    According to the notice released by the Ministry of Human Resources and Social Security and the Ministry of Finance, the standard subsidy at various levels of governments for health insurance for residents is 420 yuan per person per year, up by 40 yuan over the year 2015.

    消息称,《腾讯公司易居计划》将于5月1日正式生效。只要是腾讯的正式员工,社会工龄≤3年,还没享受过鹅厂的“安居贷款”,就可以领取租房补贴,最长可以领取3年。其中北上广深四地为15000元/年/人,其他城市为7500元/年/人。

    It is reported that “Tencent Easy Housing Program” will take effect on May 1. The full-time staff of Tencent who have a social length of service≤ 3 years and have yet to enjoy Tencent “Easy Housing Loan” are eligible to receive rental subsidies for a maximum of three years. The loan for staff in Beijing, Shanghai, Guangzhou and Shenzhen is 15,000 yuan per year per person, and 7,500 yuan per year per person for staff in other cities.

    一份10日出炉的报告显示,新毕业的大学生平均月薪不到5000元人民币。其中,硕士平均月薪为4777.9元,本科为3678.8元,专科为2939元。

    According to a report released on May 10th, the average monthly salary of fresh university graduates is less than 5000 yuan. Among them, the average monthly salary for master students is 4777.9 yuan, 3678.8 yuan for postgraduate students and 2939 yuan for junior college students.
