以“被依法追究刑事责任”为由解除劳动合同的注意事项

实践中,因劳动者被判处拘役以上的刑罚,用人单位无法就劳动合同解除事宜与其当面沟通,很多用人单位因此忽略了解除劳动合同应履行的正常程序,从而导致风险。

In practice, as the employer is unable to have a face-to-face communication on termination of employment contract when the employee is sentenced to criminal detention , the employer usually ignores the normal procedure to undergo for termination, from which risks arise.

    近日,广东省卫计委有关负责人表示:再婚家庭再生育规定和全面二孩规定一样,都将从今年1月1日起执行。但由于目前省条例修订工作正依照程序推进中,具体哪些情形能再生育还得等省条例作出具体规定。对于目前已怀孕的,建议用人单位暂不处理。

    Recently, the related official of Guangdong Provincial Health and Family Planning Commission said: the reproducive regulation for remarried families, same as the universal two-child regulation, will be implemented from Jan. 1 this year. However given that the current provincial regulation revision work is being carried forward according to the procedure, specific cases in which families can give birth to children shall be subject to the specific provisions of provincial regulations. For those who have been pregnant now, employers are suggested not to make arrangements.
