A company that winded up business but failed to expressly terminate the labor relation with its employee was judged to pay follow-up wages


The employer shall be responsible for providing the written evidence to prove it had severed the labor relation with the employee.

    26 provinces have issued the policy of old age allowance, and 30 Yuan per person per month given by Zhejiang province is the lowest


    On the 23rd, the Ministry of Civil Affairs reported that 26 provinces (districts/cities) issued the policy of old age allowance, according to which the majority of the aforesaid provinces shall grant old age allowance or nutrition fee to the elderly over 80 years old with local household registration. Wherein the allowance of 500 Yuan per month granted to centenarians in Tianjin ranks to be the highest. The standard in Zhejiang is the lowest. The elderly aged at least 80 years old shall obtain the allowance with no less than 30 Yuan per month.

    Point-based household registration policies in Beijing, Shanghai, Guangzhou, Shenzhen and Tianjin: Shanghai highlights education background, while Beijing focuses on contribution


    As the Administration Measures for Point-based Household Registration in Beijing (Trial Implementation) has been released, Beijing, Shanghai, Guangzhou, Shenzhen and other cities have proposed or implemented the point-based household registration system. The payment duration of social insurance required by Beijing is identical with that in Shanghai, namely 7 years. However, Guangzhou only requires 4 years. By contrast, policies in Beijing and Shanghai are more stricter, with provision of “social insurance shall be paid for 7 consecutive years”.

    The wage guidelines in over 10 provinces decrease or maintain the same


    Currently, the 2016 enterprise wage guidelines in over 10 provinces and cities including Beijing, Shandong, Shanxi, Inner Mongolia, Tianjin, Xinjiang, Sichuan, Yunnan, Shaanxi, Jiangxi and Hebei have been released. Compared with 2015, the enterprise wage guidelines in the majority of the aforesaid regions maintain the same or even decrease.

    According to the Notice on Periodically Lowering the Payment Ratio of Employee’s Social Medical Insurance (Exposure Draft) issued by Guangzhou Municipal Human Resources and Social Security Bureau last Tuesday, the payment ratio of employee’s social medical insurance attributable to employers is reduced to 7% from the original 8%.

    So far, at least 10 provinces, in their local labor protection methods for female employees, have proposed that female employees can take the “dysmenorrheal leave” under certain conditions of no more than 2-3 days.

    Recently, the Opinions of People’s Government of Shandong Province on Applying Comprehensive Policy Measures to Expand Consumption proposed 40 measures in 10 categories to expand consumption, such as equal pay for equal work in enterprises and public institutions, having wages of some teachers employed by non-government primary and secondary schools attributable to the government, using healthcare card for fitness and corresponding wage paid by employers failing to arrange annual leave.
