人事经理未签劳动合同是否可主张双倍工资?

Can the HR manager claim double pay on the ground of the absence of labor contract?

现在该员工声称公司未与其签订书面劳动合同,要求支付双倍工资,请问她的要求合法吗?

Now this employee claimed that the company didn’t sign a written labor contract with her, and asked for double pay on this ground. We want to know whether her request is legally tenable?

    Administrative Provisions on the Employment of Foreigners in China (2017 Revision) were Promulgated

    日前,人社部发布通知:《人力资源社会保障部关于修改〈外国人在中国就业管理规定〉的决定》已经2017年1月22日人力资源社会保障部第116次部务会审议通过,并商公安部、外交部、商务部同意,现予公布,自公布之日起施行。

    A few days ago, MOHRSS released a notice: the Decision of the Ministry of Human Resources and Social Security on Revising the Administrative Provisions on the Employment of Foreigners in China has been approved during MOHRSS’s No. 116 conference of department affairs on 22 January, 2017, and the same was also agreed by Ministry of Public Security, Ministry of Foreign Affairs and Ministry of Commerce through consultation. The revision of such provisions are hereby promulgated and shall come into force as of the date of promulgation.

    MOHRSS: Technical Staff of the Public Institutions are Encouraged to Start their Own Business

    近日,人社部印发通知,鼓励高校、科研院所专业技术人员等事业单位技术人员离岗创新创业,3年内保留人事关系,离岗创业期间保留基本待遇。

    Recently, MOHRSS has printed and issued a notice to encourage the technical personnel from colleges, research institutes and other public institutions to leave their positions and start their own business. Their organizational affiliations shall be retained for 3 years during which a basic salary will be granted.

    The lower house of Italy’s parliament has started discussing a draft law that, if approved, will mandate companies to grant three days of paid leave each month to female employees who experience painful periods. Italy might soon become the first Western country with an official menstrual leave policy for working women.

    3月21日,深圳市人民代表大会常务委员会发布通知,《深圳经济特区人口与计划生育条例》正式废止。原条例的废止意味着,深圳女性不再享有15天晚育假。

    On 21 March, the Standing Committee of Shenzhen Municipal People's Congress passed a resolution by vote to abolish the Regulations of Shenzhen Special Economic Zone on Population and Family Planning, which means the female workers in Shenzhen will no longer be able to enjoy 15-days maternity leave for late childbearing.

    Japan Pension Service recently announced a new policy that anyone who hasn’t pay the national pension insurance (i.e. endowment insurance) may be subject to compulsory collection if his/her annual salary is over 3 million yen (about 27,000 USD).
