客观情况变化解除

Termination Due To Change in Objective Circumstances

"客观情况发生重大变化"的范围更广,如立法变化、用人单位生产经营变化、不可抗力等,但解释标准应以字面解释为准,即强调相对于主观的客观性,不得将劳动者或用人单位的主观认识作为依据。

From practical perspective, “fundamental change in objective circumstances” have a larger extensioin, such as change in legislation, change in production and operation of the employer, force majeure and etc, but the interpretation criteria shall focus to literal interpretation, i.e. emphasizing the objectivity as opposed to subjectivity and should not be based on the subjective understanding of the employee or employer.

    广东省政府透露,广东目前用滚存结余养老金投资运营产生的收益不应区分统筹基金收益和个人账户基金收益,而应将投资运营收益全额计入滚存结余基金。

    The Government in Guangdong Province has recently revealed that it is not reasonable to make the distinction between the revenue generated from pooling fund and the revenue generated from personal account fund for the revenue generated from rolling-balance pension investment. The revenue generated from rolling-balance pension investment should all be accounted into the rolling-balance pension.

    Shanghai has made adjustment to the minimum wage

    上海市从4月1日起,将劳动者月最低工资标准将从1450元调整到1620元;小时最低工资标准从12.5元调整到14元。

    From April 1st, Shanghai has made adjustment to the minimum wage of employees from RMB 1450 to RMB 1620; and the hourly minimum wage has been adjusted from RMB 12.5 to RMB 14.

    Shenzhen has started special inspection for social insurance

    深圳于4月1日起启动社会保险法律法规专项检查。对用人单位瞒报、欠缴等社会保险违法行为,市社会保险基金管理局将责令其限期补缴社会保险费,依法加收滞纳金,还有可能对其处以欠缴数额1倍至3倍的罚款。

    Shenzhen has started special inspection for social insurance laws and regulations since April 1st. The Social Insurance Fund Management Board in Shenzhen will order the payment of social insurance plus social insurance premiums for the concealing and non-payment of social insurance of the employing unit. In addition, the Board may also impose a penalty ranging from 1 to 3 times of the unpaid amount.

    Shanghai has become the most preferential city for job hunters

    国内知名求职网站前程无忧发近日发布报告称,在求职者首选城市方面,17%的受访者表示将上海作为最近一年跳槽的首选目标工作城市;12%的受访者首选广州;8%的受访者首选深圳。

    51Job, one of the most popular job-seeking websites in China, has recently released the report that, 17% of the respondents report that Shanghai is the most preferential city for starting a new job in one year; and 12% of the respondents make the choice of Guangzhou, and the other 8% chooses Shenzhen.

    教育部留学服务中心日前发布“2012万名留学人员回国就业报告”,报告显示,所有留学回国人员中,具有硕士学位的人数占76%,博士学位占11.2%,学士学位占11.9%,其中,大部分留学回国人员年龄分布在24—30岁这个区间,占全部回国人员的80%。

    Overseas Study Service Center of the Ministry of Education has issued the Return Employment Report of 20.12 million Overseas Students recently. The report shows that among the overseas students who return to work in China, 76% of them earn the master degree, 11.2% of them earn the doctoral degree, and 11.9% of them earn the bachelor’s degree. Most of them are aged from 24 to 30 years old, which account for 80% of all returning students.

    The Human Resources Service Center in Guangzhou has recently released the Market Research Report for Human Resources Service in Guangzhou (after 2013 Festival). It shows that the requirement rate of the human resources market in Guangzhou is higher than 1.23 currently, which means that for every 2.5 positions, there are only two corresponding job hunters.

    自2013年4月1日起,上海市城镇职工基本医疗保险统筹基金和小城镇医疗保险基金的最高支付限额从28万元提高到34万元,“封顶线”以上的医疗费用,仍可报销80%。

    Since April 1st, 2013, the maximum payment of basic medical insurance pool fund for urban employees and the medical insurance fund for small-town employees has raised from 0.28 Million to 0.34 Million in Shanghai. And the medical expenses above the cap line can still be reimbursed by 80%.
