公司要求产假女职工提前回岗上班,是否要支付加班费?

If the company asks a female employee who is on maternity leave to come back to work early, does the company need to pay overtime salary?

我公司有一女员工产假未休满提前30天回到公司上班,离职时提出原来有30天产假未休,并以此要求公司多支付一个月的加班工资,请问该要求是否合法?

A female employee resumes work thirty (30) days ahead of the expiration of her maternity leave. When leaving office, she proposed that she still had 30-day maternity leave and asked our company to pay one-month salary additionally. Is this request legitimate?

    29 provinces of China have published their own average salary in 2016:

    目前,除西藏、黑龙江2地外,其余29省份均已公布2016年平均工资数据。与2015年相比各省职工收入不同幅度有所增加,但大多未超年度全国平均工资水平。以城镇非私营单位就业人员平均工资计算,北京职工年入近12万元居首,河南不足5万元垫底。

Compared with 2015, the income of workers in different provinces has witnessed increase of different degree, while the majority no more than the annual average salary nationwide. Calculated on the average salary of urban employees other than those in private units, the annual income of employees in Beijing is near RMB 120,000.00, and that in Henan less than RMB 50,000.00 to be the lowest one.

    On October 30, Nikon formally declared that, the business activities of NIC in Wuxi, Jiangsu would be terminated. As reported, the lock-out this time refers to 2268 employees, who bear no job-transfer opportunity according to the production structure adjustment of Nikon in China. From now on, Nikon will initiate the procedure of terminating labor contracts with employees.

    湖南省人社厅10月30日发布通知,明确今年湖南省以在岗职工货币平均工资增长率8%作为企业工资增长的基准线,以在岗职工货币平均工资增长14%为上线(预警线),以在岗职工货币平均工资增长率2%为下线。

    According to the notice issued by the Department of Human Resources and Social Security of Hunan province on October 30, this year, the growth rate of 8% based on the average salary of on-the-job staff in Hunan province shall be deemed as the base line of enterprise salary growth, 14% as the upper line (precautions line) and 2% as the lower line.
