员工离职时,未休年休假如何处理?

How to deal with the untaken annual leave when the employee leaves the employer?

如果用人单位想尽量不支付未休年假补偿的,建议要让员工在离职前使用完毕未休年假,通常的做法是在离职前的最后一个月安排员工休假。

If the employer intends not to pay compensation for the untaken annual leave, it is suggested that the employee use up of the untaken annual leave before his departure.

    深圳市社保局日前透露,深圳企业退休人员养老保险待遇上调280元,调增额近期发放到位,并从今年1月1日起补发。

    Shenzhen Human Resources and Social Security Bureau recently said that the old-age pension for enterprise retirees in Shenzhen will be increased by RMB 280. The new standard will be enacted soon and the incremental amount will be issued starting from January 1, 2013.

    广州市人社局日前公布《广东省劳动保障监察条例》细节。从今年5月1日起,用工需建立管理台账,准确记录职工名册、录用登记、工时、工资等,并且需保留台账两年,违规最高可处以2万元罚款。

    Guangzhou Municipal Human Resources and Social Security Bureau recently released details on the Guangdong Provincial Labor Security Supervision Regulations, stating that management ledgers must be established for employment from May 1st onwards, to accurately record the roster of employees, employment registration, working hours, wages and other information accurately, and the ledgers must be retained for two years. Those in violation may be imposed of a fine up to RMB 20,000.

    Maternity insurance is officially launched in Guangzhou recently. The maternity medical expenditure of participants that meet relevant maternity insurance regulations will be recorded by the designated medical institutions and will be settled in real time.

    Beijing New Policy on Provident Fund Loan: Monthly Mortgage of High-income Earners Shall Be Greater Than Half of Their Monthly Salary

    北京公积金管理中心日前发布正式通知,今后将根据借款申请人的月收入确定贷款额度。如果借款申请人人均月收入超过北京市职工月平均工资3倍(含)以上,月还款额原则上应不低于其月收入的50%。

    Beijing Provident Fund Management Center recently issued a formal notice, stipulating that the loan credit will be determined based on the applicant's monthly income. Where the per capita monthly income of the applicant exceeds three times (including) of Beijing's average monthly wage, then the mortgage amount shall be more than 50% of their monthly income in principle.

    Cross-border Taiwan-funded Enterprises May Apply for Dispatching up to 20 Mainland Residents to Work in Taiwan

    台湾内务部门日前发布“跨境企业内部调动之大陆地区人民申请赴台服务许可办法”,母公司或本公司设于台湾,且在台设有营运总部的跨境企业,可申请最多10名大陆人民赴台停留1年以上,不满一年者,最多可有20名。

    Taiwan's “Department of Internal Affairs” recently promulgated the Methods on Licensing Cross-border Taiwan-funded Enterprises' Application for Dispatching of Mainland Residents to Work in Taiwan. The Methods provide that cross-border Taiwan-funded enterprises with the parent company or operational HQ located in Taiwan can apply for dispatching 10 Mainland residents to work in Taiwan for over a year; if the period of stay is less than one year, then the total dispatched number can be increased to 20.

    National Bureau of Statistics of China released China's national economic performance in the first quarter of 2013. Wherein, GDP experienced a year-on-year growth of 7.7%, increased by 1.6% compared with the fourth quarter of 2012, though lower than the expected 7.9%.

    51Job, a human resources service provider in China, recently released the Employers' Recruitment Intention Survey of Q1 2013. The report shows that Chinese employers' recruitment will become more active, with over 70% of the surveyed saying that they would recruit more employees in 2013 compared with the same period in 2012.
