公司新招聘了一名外籍员工,请问公司是否必须为其缴纳住房公积金?

Our company has recently hired a foreign employee, for whom have we to contribute to the housing provident fund?

外籍员工提出不缴纳住房公积金,请问公司是否可以不为其缴纳住房公积金?是否有什么法律风险?

  • 住建部:降低企业公积金缴存比例政策延期两年

    MOHURD: Extend the policy of reducing the contribution ratio of the housing provident fund by two years

    4月9日,住建部计划财务与外事司张兴野司长在国务院例行政策吹风会上表示,为了落实国务院常务会议的决定,住建部拟采取的主要措施其中有将阶段性适当降低企业住房公积金缴存比例政策期限延长两年,延长至2020年4月30日。

    On April 9, ZHANG Xingye, Director of the Planning, Finance and Foreign Affairs Department of the Ministry of Housing and Urban-Rural Development of the People's Republic of China (MOHURD), said on a regular policy briefing meeting of the State Council that, in order to implement decisions of the State Council Executive Meetings, MOHURD would adopt a variety of major policies, including extending the phased policy of appropriately reducing the contribution ratio of the housing provident fund by two years to April 30, 2020.

    近日,金立方面发布声明称,未来金立工业园将保留50%左右的员工继续生产,金立方面还称,与员工解约是以平等自愿为原则,并非强迫行为。同时补偿标准将严格执行《劳动合同法》相关条款,对离职员工按照“n+1”的方式进行补偿,并与员工签订补偿协议书,经济补偿金分期支付,自补偿协议签订次月起开始支付,按每月支付1个月补偿金的方式进行,最长8个月内支付完毕。

    Recently, GIONEE issued an announcement, stating that in the future, GIONEE Industrial Park would retain around 50% of its employees to continue production. The company also said that the termination of labor contract with employees is based on the principle of equality and voluntariness rather than compulsion. Meanwhile, the compensation standard will strictly comply with relevant provisions of the Labor Contract Law. Laid-off employees will receive a compensation based on "n+1". The company will sign a compensation agreement with the employees, which prescribes that the economic compensation will be paid in installments; that is, the compensation will be made monthly starting from the second month after the signing of the compensation agreement, and all the compensations will be paid up within a maximum period of eight months.

The original policy is about to expire on April 30, 2018, which is now extended by one year to April 30, 2019. It is estimated that this could reduce the costs of enterprises by approximately RMB 54 billion.

    Recently, the Japanese government promulgated a series of new laws on labor reform, in order to eliminate the bad practice of working overtime in Japanese enterprises. The new law stipulates that employees' overtime cannot exceed 45 hours per month in principle. If the work is really busy, the enterprise may apply to extend the overtime hours which must be controlled within 100 hours.
