订立无固定期限劳动合同时,能否变更员工的岗位和薪酬?

Can the employee's position and salary be adjusted when entering into the non-fixed term labor contract?

一般我们通常讲到的在签订无固定期限劳动合同上,公司拥有一定的主动权的,是指在08年以后2次固定期限劳动合同的情形,而非满10年的这种情形。

When we say that the employing unit has a certain initiative in signing non-fixed term labor relations, it refers to cases of having signed two times of fixed-term labor contracts after 2008, but not cases of having served the company for 10 years.

    China Intends to Include All Taxpayers in the Forcible Enforcement Scope of Tax Preservation

    国务院法制办近日公布了《中华人民共和国税收征收管理法修正案(征求意见稿)》 ,规定将税收保全、强制执行的范围由“从事生产经营的纳税人”扩大到包括自然人在内的所有纳税人,并规定可以对个人取得收入单位与纳税 相关的账簿和资料进行税务检查。

    The State Council recently promulgated the Revision of Law of the People's Republic of China on the Administration of Tax Levying (Exposure Draft), providing to extend the forcible enforcement scope of tax preservation from "taxpayers engaged in production" to all taxpayers including natural persons. It also states that account books and information of the unit where the individuals obtains his income can be audited by tax departments.

    New Standards for Life Insurance Disability Evaluation Will Be Enacted Next Year

    从明年1月1日起,人身意外伤害险理赔将根据新的评定标准执行,意外险伤残理赔范围大幅扩大。新标准增加了神经精神和烧伤残疾,扩大了胸腹脏器损伤、智力障碍等残疾范围,伤残条目也大幅扩展到10个伤残等级、281项伤 残条目。

    New evaluation standards for personal accident insurance claims will be enacted from January 1, 2014 onwards. The new standards significantly expand scope of accident insurance disability claims: adding the neuropsychiatric damages and burns while expanding the disability scope of chest organ damages and mental retardation, covering 10 disability ratings and 281 entries in total.

    Guangdong: Medical Insurance Can Be Transferred within the Province from Next Month

    广东省人社厅、财政厅于日前下发《关于印发广东省流动就业人员基本医疗保险关系转移接续暂行办法的通知》,规定广东省内医保转移,缴费年限予以累计计算。该政策将于7月1日开始正式实施。

    Guangdong Human Resources and Social Security Department and the Department of Finance recently released the Notice of Guangdong Province on the Printing and Distribution of the Temporary Measures on the Basic Medical Insurance Transfer and Renewal for Migrating Employees, regulating that for inter-province medical insurance transfer, the contribution period shall be accumulated. This policy will be implemented on July 1.

    Shenzhen: Salary During Maternity Leave Will Be Covered by Maternity Allowance

    深圳市社保局近日透露,深圳新的《生育保险条例》已起草完毕,已纳入政府立法规划,即将提交人大审议。条例拟规定,女职工的产假工资将由生育津贴发放,而不是企业发放。

    Shenzhen Municipal Human Resources and Social Security Bureau recently revealed that Shenzhen had drafted the new Maternity Insurance Regulations, which has been incorporated into the municipal government's legislative plan and is about to be submitted to the municipal people's congress for deliberation. The Regulations propose that female employees' salary during maternity leave will be covered by maternity allowance instead of by the enterprise.

    北京市人保局、市统计局日前公布2012年度北京市职工月平均工资为5223元,比上年增长11.8%。

    Beijing Municipal Human Resources and Social Security Bureau and Beijing Statistics Bureau recently publicized the average monthly wage of workers in Beijing for 2012, at RMB 5223, increased by 11.8% compared with 2011.

    Latest Kelly Global Workforce Index (KGWI) shows that employees born in the 80s have highest level of loyalty to their employers. Wherein, 71% of them attend trainings driven by the desire for promotion, higher than those born in the 70s (64%) and 60s (49%).

    According to the China Monitor 2013 Q1 Report recently published by HR consulting firm Mercer, the annual wage growth in 2013 is estimated at 8.7%, significantly decreased compared with 2012's 9.4%. Wherein, only 55% of the surveyed have campus recruitment program, while technical departments need more graduates with higher starting salary.

    Everbright Bank of China released China's first old-age consumption index, which shows that over 80% of the aged in China choose to stay at home to live out their life in retirement, and they require about RMB 2000 to 4000 per month to maintain current standard of living.

    The China Graduate Employment Report 2013 released by the investigation agency MyCos shows that, the turnover rate of college graduates within six months after graduation is on a decreasing track. Wherein, 33% of college graduates 2012 have quit their jobs within six months of leaving school, 8% lower than graduates 2011 (41%).
