Analysis on the Opinions on Certain Issues Concerning the Implementation of the Regulations on Work-Related Injury Insurance

2013年4月25日,人力资源社会保障部发布了《关于执行<工伤保险条例>若干问题的意见》并自即日起实施。将此与之前的征求意见稿相比,正式稿就事实认定、工伤待遇及工伤认定程序问题作出了厘定。

On April 25th, MOHRSS issued the Opinions on Certain Issues Concerning the Implementation of the Regulations on Work-Related Injury Insurance , which becomes effective as of the date of issuance. Compared with the version open to public comments, the Opinions clarifies less controversial questions like facts finding, work-related injury compensation, identification procedures of work-related injury, etc..

  • 劳务派遣岗位拟不超职工总数10%

    The quantity of work posts for labor dispatch will not exceed 10% of the total number of employees

    《劳动合同法修正案》将从7月1日起实施,人社部专家近日解读《修正案》时表示,对劳务派遣问题有望出台规章,对其岗位数量加以限制,拟最多不能超过本单位职工总数的10%。

    An Amendment to the Labor Contract Law will be implemented from July 1st. When interpreting this Amendment recently, the expert of the Ministry of Human Resources and Social Security said that regulation on the issue of labor dispatch was likely to be enacted, limiting the quantity of its work posts to at the most 10% of the total number of the employees of a unit.

    Ministry of Human Resources and Social Security: “the most difficult year for employment in the history” may last for another five years

    人社部部长尹蔚民尹蔚民介绍,未来5年,高校毕业生就业规模保持在年均700万左右,约占每年新进人力资源市场劳动力的一半,且这一比例将进一步提高,再加上中等职业院校毕业生、城镇未能升学的初高中毕业生和退役士兵,总量近1600万人。

    Mr. Yin Weimin, the Minister of the Ministry of Human Resources and Social Security said, in the next 5 years, the number of university graduates for employment would be kept at approximately 7 million a year, accounting for one half of the workforce newly entering the human resources market, and this proportion may be further increased. The total number of each year’s new workforce, including university graduates, graduates from secondary vocational schools, junior and senior high school students in cities and towns failing to enter universities, and retiring soldiers would reach nearly 16 million.

    Design of pension reform program is likely to be initiated

    消息称,中国养老保险制度的整体改革方案设计已经启动,由人社部部长尹蔚民直接负责。其内容涉及破除养老金双轨制、做实空账、提高养老金统筹层级与养老基金入市投资等多方面。

    It is said that the design of the overall reform of Chinese endowment insurance system has been initiated, which is directly led by Mr. Yin Weimin, the Minister of the Ministry of Human Resources and Social Security. This reform is relating to many aspects, such as eliminating the “dual-track” system of pension, replenishing empty account, boosting the level of pension planning, and investing pension by means of entering the market etc.

    Shanghai issues high-temperature allowance from this month

    今年上海高温津贴不变,每月200元。此标准适用于全市范围内的所有企业及其使用的劳动者,执行时间为6月1日至9月30日,共四个月。

    Shanghai’s high-temperature allowance this year is 200 yuan per month, which is the same as before. This standard applies to all the enterprises and their employees in the city, and will be implemented for four months from June 1st to September 30th.

    智联招聘发布《2013北京高校应届毕业生就业形势报告》。报告显示,珠三角应届生岗位竞争最为激烈。从薪酬来看,上海以平均月薪4859元在毕业生薪金排行榜上名列第一,而北京和深圳则分别以平均月薪4746元和4494元位居第二和第三。

    Zhaopin.com has released a Report of Employment of Current Year’s Graduates from Universities of Beijing in 2013, which shows that the graduates in the Pearl River Delta face the fiercest competition for work post. From the point of salary, the average monthly salary of the graduates in Shanghai is 4859 yuan, ranking the first. The average monthly salary in Beijing and Shenzhen is 4746 yuan and 4494 yuan, ranking the second and the third respectively.

    人力资源服务商万宝盛华集团日前对中国大陆地区4241家企业开展了最具前瞻性的雇佣前景调查,结果显示,在2013年第三季度,14%的雇主预期将增加员工数量,只有2%的雇主预计将减少劳动力。

    Recently, Manpower Group, a supplier of human resources service, carried out a prospective survey of employment outlook among 4241 enterprises of Mainland China, which showed that in the third quarter of 2013, 14% of employers expect to increase the number of employees, and only 2% of employers expect to decrease such number.

    从7月1日起 ,2013年度北京住房公积金月缴存额上限为3760元,本年度的缴存上限比上一年度增加了396元。职工和单位月缴存额上限均为1880元。

    From July 1st, the upper limit of monthly payment of Beijing’s housing fund in 2013 will be 3760 yuan, which is increased by 396 yuan comparing with that of the previous year. The upper limit of employee’s and employer's payment is both 1880 yuan.

    上海市公积金中心宣布,2013年度(2013年7月1日至2014年6月30日),公积金月缴存额上限为1970元,下限为204元。

    Shanghai Accumulation Fund Center announced that, in 2013 (from July 1st, 2013 to June 30th, 2014), the upper limit of monthly payment of accumulation fund is 1970 yuan, and the lower limit is 204 yuan.
