合同期、医疗期满前后的病假操作

Treatment of various circumstances before and after expiration of contract term and medical treatment period

劳动者在医疗期、孕期、产期和哺乳期内,劳动合同期限届满时,用人单位不得终止劳动合同。劳动合同的期限应自动延续至医疗期、孕期、产期和哺乳期满为止。

Employer shall not terminate the labor contract with its employee during his/her medical treatment period, pregnancy, perinatal period, and breastfeeding period, even when the labor contract expires. The term of the labor contract shall be extended automatically to the end of employee's medical treatment period, pregnancy, perinatal period, and breastfeeding period.

  • 监察部:超标缴存公积金将被撤职

    Ministry of Supervision: those who excessively deposit public reserve funds will be removed from their positions.

    监察部近日发布《违规发放津贴补贴行为处分规定》明确,超标准缴存住房公积金情节严重的,对其负有责任的领导人员和直接责任人员,以及有违规发放津贴补贴行为的个人,将给予降级或者撤职处分。该规定从8月1日起施行。

    The Regulation on Punishment for Illegal Issuance of Subsidies and Allowances promulgated by the Ministry of Supervision clearly stipulates, in case of serious deposit of house reserve funds in excessive of relevant standard, the leader responsible for it, the directly responsible person, and the person illegally issuing subsidies and allowances will be demoted or removed from positions. Such regulation will be implemented as of August 1st.

  • 营改增试点正式在全国范围内推开

    The experiment of conversion from business tax to value added tax will be rolled out formally all over the country

    8月1日起,交通运输业和部分现代服务业营业税改征增值税试点将在全国范围内推开。据测算,本轮试点扩容后,全年将直接为纳税人减税1200亿元。

    From August 1st, the experiment of conversion from business tax to value added tax in transportation industry and part of modern service will be rolled out all over the country. Based on estimation and calculation, after expansion of the experiment, the tax paid by taxpayers will be decreased by 120 billion yuan a year.

    Five schemes of pension reform have been submitted to the Ministry of Human Resources and Social Security

    来自中国社科院、人民大学、清华大学、武汉大学和浙江大学的五套社保改革方案已提交人社部,将在年内形成部门方案并提交国务院。其中,就“统账结合”的基本制度模式如何改革,学界方案仍存分歧。

    The five schemes concerning pension reform established by China Academy of Social Sciences, Renmin University of China, Tsinghua University, Wuhan University and Zhejiang University have been submitted to the Ministry of Human Resources and Social Security, which will be formulated as department scheme and submitted to the State Council. In these schemes, there are still different opinions with respect to the reform of the basic “integration mode of social pooling and personal account”.

    Beijing Human Resources and Social Security Bureau defines the procedures for mediation of labor and personnel dispute

    北京市人力资源和社会保障局近日发文明确北京市劳动人事争议调解协议经仲裁审查确认后将具法律效力。新政策将自8月1日起正式执行。

    Beijing Human Resources and Social Security Bureau issued a document recently, confirming that the mediation agreement for labor and personnel dispute in Beijing will be legally binding upon arbitration and examination. The new policy will be formally implemented from August 1st.

    Guangzhou’s new social security card can activate medical insurance function

    广州新社保卡目前可以激活医保功能。新版社保卡集合了医保卡、诊疗卡、银行借记卡等多重功能。在新版社保卡的医保功能成功激活后,参保人原医保卡或旧版社保卡中的个人医疗账户资金将转入新卡,消费密码不变。

    Guangzhou’s new social security card can now activate medical insurance function. This new social security card plays several roles, such as medical insurance card, medical treatment card, and bank debit card etc. After successful activation of the medical insurance function of the card, the funds in the personal medical saving account in the former or old social security card will be transferred to the new one, with the consumption password remaining unchanged.

    According to the statistics released by Guangzhou Labor and Employment Service Management Center, the growth rate of Guangzhou employee’s wage is 8.4% in the first half of this year, lower than the growth rate of Guangzhou’s GDP.
