异地用工模式的选择

Inter-region employment models

母公司为了有效地控制子公司,往往会将子公司关键岗位人员由母公司派驻和任免。那么这时,这些派驻人员的劳动关系归属于母公司还是子公司?

In order to effectively control subsidiaries, a parent company often dispatches and appoints/dismisses personnel for key positions of the subsidiary. If this is the case, do the labor relations of the dispatched employees belong to the parent company or the subsidiary?

  • 对于异地用工的企业来说,如果在异地没有法定分支机构,即无法采取属地化,那么将无法为派驻人员缴纳当地社保。
  • Therefore, if an enterprise dispatching employees to a place other than its registered place has no branch in the local place, it cannot contribute social insurance for such employees in the local place.

  • 人社部就劳务派遣若干规定公开征求意见

    Ministry of Human Resources and Social Security seeks public opinions on the regulations regarding labor dispatch

    人力资源社会保障部近日公布《劳务派遣若干规定(征求意见稿)》向社会公开征求意见。意见稿提出用工单位在辅助性岗位使用的被派遣劳动者数量不得超过用工总量的10%。同时,被派遣劳动者在用工单位发生工伤的,用工单位不仅要协助调查处理,还要承担相应的赔偿责任。

    The Ministry of Human Resources and Social Security seeks public opinions on the Regulations of Labor Dispatch (Exposure Draft) recently promulgated. This draft stipulates that the number of dispatched laborers used by employer for auxiliary posts should not be over 10% of the total employees. In the mean time, in case of any work-related injuries suffered by dispatched laborers at employing units, employer should not only assist in their investigation and treatment, but also assume related indemnification.

    Enterprises in Guangdong will submit 2% of their total salary as expenditure of trade union

    8月15日起,广东企业将向地税部门缴交“工会经费”,这笔钱按照每月全部职工工资总额的2%计算。

    As of Aug. 15th, enterprises in Guangdong will pay “trade union expenditure” to the local taxation authorities, which should be equal to 2% of their employees’ total salary of each month.

  • 深圳:企业转型升级不得擅自降薪裁员

    Shenzhen: enterprise should not reduce salary or staff without authorization during transformation and upgrade

    深圳市人社局日前转发广东省意见,提出企业因转型裁员20人以上需人向劳动保障部门报批后才可裁减人员并依法支付经济补偿,转型后不得擅自降低薪酬。

    The Human Resources and Social Security Bureau of Shenzhen recently forwarded a stipulation of Guangdong Province, proposing that enterprise must obtain approval from labor security department and effect financial indemnification by operation of law before cutting redundancies of more than 20 due to transformation, and should not reduce salary without authorization after transformation.

    深圳市人社局日前解释称,参保人加入外国国籍后可申请终止养老保险关系,也可以继续保留养老保险关系。保留养老关系者,符合领取养老金规定时,可按规定享受相应养老保险待遇。

    The Human Resources and Social Security Bureau of Shenzhen recently explained and stated that participant of endowment insurance may apply to terminate the relationship of endowment insurance or continue to maintain it after acquiring foreign nationality. In case of maintaining the relationship, participant may enjoy related pension when conforming to the conditions with respect to receiving pension.

    Hubei plans to stipulate that employer should not dismiss representative of collective bargain

    湖北省人大常委会近日对《湖北省集体合同条例(修订草案)》进行审议。草案拟规定,协商代表履职期间,用人单位无正当理由不得调整其工作岗位、免除其职务、降低其职级。

    The Standing Committee of the People’s Congress of Hubei Province recently examined and discussed the Regulation of Collective Contract of Hubei Province (Revised Draft). This draft stipulates that employer should not, without proper reason, adjust the post, oust the position or demote the level of representative of collective bargain during his/her performance of duties.

    According to a news report of the Voice of China, the latest statistics shows that, together with the university students graduating in the previous years who fail to obtain jobs by far, there may be over 3 million university graduates this year who cannot obtain jobs initially.

In the meantime, 7% of employees expect to a salary increase of 3% - 6%, and 21% of employees expect 0% - 3%.

    今年上半年广州市就业景气指数发布,高校毕业生就业状况堪忧,其中到今年6月底在市就业中心登记的离校未就业的2012届高校毕业生仍有1393名,是去年的3.54倍。

    The employment index of Guangzhou for the first half of this year has been released, which shows that the employment of university graduates is worrying. By the end of June of this year, there were still 1393 university students graduating in 2012 and registered at the city’s employment center who had not obtained jobs. This number is 3.54 times of the last year’s number.
