    MOHRSS and Supreme People’s Court: state expressly that the 996 working system is severely illegal

    近日,据报道,人社部、最高人民法院联合表示,996工作制被认定为无效。劳动者与用人单位订立放弃加班费协议,仍能拿加班费。用人单位与劳动者约定实行包薪制,仍需支付加班费,且协商一致,增加工作任务,劳动者有权拒绝。

    As reported recently, MOHRSS and Supreme People’s Court have jointly expressed that the 996 working system has been identified as invalid. Employees may still receive overtime pay even signing an agreement with the employer on abandoning overtime pay. The employer shall still pay overtime pay even agreeing on practicing the pay package system with employees. Moreover, employees shall be entitled to refuse any increase in work tasks, as agreed upon.

    Guangzhou: progressively lower the rate of contribution to workers’ social medical insurance and birth insurance

    近日,据报道,广州市发布《通告》,明确减半征收政策结束后,自2021年10月1日起至2022年12月31日止,用人单位的职工社会医疗保险单位缴费率降低为5.45%(含生育保险费率0.45%),灵活就业人员、退休延缴人员、失业人员的职工社会医疗保险缴费率降低为7%。

    As reported recently, Guangzhou municipality has released a Notice to lower the rate of contribution to workers’ social medical insurance from employer to 5.45% (including the rate of birth insurance premium, 0.45%), whereas the rate of contribution to workers’ social medical insurance is to be lowered to 7% for flexible employees, retirees delaying to pay, and unemployed individuals, starting from October 1, 2021 to December 31, 2022, after the halving-levy policy is over.

    As reported recently, Hainan Province has printed and issued Detailed Rules on Incentives, specifying that high-tech enterprises which have immigrated as a whole into Hainan within the effective period will be offered incentives in terms of fixed assets investment, R&D investment, etc. over the 12 months after the enterprises have completed immigration registration, and that the limit shall be 5% of fixed assets investment or 10% of R&D investment completed by enterprises and up to 5 million CNY at maximum. The immigration incentives may be applied for only once. The new regulation will be implemented up from September 11 this year.
