未办理就业证的涉外劳动合同效力认定

The validity of foreign related employment contract in the case that the employee does not obtain the Employment Certificate

为外国人办理就业证属于一种行政许可,那么在未取得就业证前,外国劳动者的身份、能力、资格等未经劳动行政部门的确认与批准,也就不具有我国劳动法意义上劳动者的主体资格。

Since the Employment Certificate for foreigners is an administrative permit, foreign laborers whose identity, competence and qualification have not been confirmed and approved by the labor administrative authority are not eligible employee referred to in China’s labor law.

    十二届全国人大常委会第四次会议日前表决通过新修改的《商标法》。新《商标法》加大了对商标侵权行为的处罚力度,赔偿额由现行法最高额50万元提高上限额到300万元。修改后的《商标法》是从2014年5月1号起实行。

    The Fourth Session of Twelfth NPC Standing Committee recently voted on and passed the revised Trademark Law of the People's Republic of China. The new Trademark Law, which will be enacted from May 1, 2014 onwards, has significantly increased penalties for trademark infringement, from a cap of RMB 500,000 in the existing law to RMB 3 million.

    Shenzhen Municipal Human Resources and Social Security Bureau: Those Violating Regulations on Talent Introduction Cannot Apply for Talent Introduction in Five Years

    深圳市人力资源和社会保障局透露,该局近期发现多起违规申办人才引进业务的行为。市人社局称,申请人有提供虚假材料等行为的,记入本市人才引进征信系统,5年内不得申办人才引进业务;涉嫌犯罪的,移送司法机关依法处理。

    Shenzhen Municipal Human Resources and Social Security Bureau revealed that recently it had detected several violations in talent introduction application. The bureau also said that behaviors of providing false materials for talent introduction or having other violations would be recorded in Shenzhen's talent introduction credit system, and applicants having breaching behaviors cannot apply for talent introduction in five years. Where crimes are suspected, those concerned will be transferred to judicial organs in accordance with the law.

    北京市人力资源和社会保障局日前发布了《社会保险工作人员纪律规定实施细则》,明确提出了“36个不准”,包括未经两次审核不能提前退休等。这是本市首个针对社保工作人员的行为规范。

    Recently, Beijing Municipal Human Resources and Social Security Bureau promulgated the Implementation Details on the Regulations of Social Insurance Worker Discipline, expressly putting forward "36 don'ts", including "no early retirement without two times of audits". This is Beijing's fist code of conduct for social insurance workers.

    Guangzhou Will Raise Individual Contributions for Medical Insurance on a Full Scale

    广州市人力资源和社会保障局发布通知称,9月1日起,广州市城镇居民医保缴费标准将全面上调。其中,未成年人及在校学生筹资标准为440元/人·年,其中个人缴费120元/人·年;非从业居民筹资标准为920元/人·年,其中个人缴费600元/人·年。

    Guangzhou Municipal Human Resources and Social Security Bureau recently publicized a notice, stating to increase the medical insurance contribution standards of Guangzhou urban residents on a full scale from September 1 onwards. Wherein, the contribution standard of minors and students is 440 yuan/person/year, 120 yuan of which shall be paid by individuals; the contribution standard of non-working urban residents is 920 yuan/person/year, 600 yuan of which shall be paid by individuals.

    The Social Investigation Center of China Youth Daily has conducted a survey titled "what is your attitude toward delay retirement?" for 25311 people. The result shows that 94.5% of the surveyed expressed their explicit opposition to delay retirement, and only 3.2% sided with it, while 2.3% chose to be neutral or expressed no opinion.
