劳动争议案件中“上诉不加重”原则的适用

Applicability of the "No Aggravating Punishment On Defendants from Appeals" Principle in Labor Disputes

实践中,对于不服仲裁裁决起诉至法院的案件,当事人双方是可以重新提交证据材料的,该证据材料可能跟仲裁阶段提交的证据材料不一致,法院会根据当事人新提交的证据材料作出裁判。

In practice, when parties concerned refuse to accept the arbitration award, they can bring the case to court and resubmit evidence materials. The evidence materials submitted to the court may differ from those submitted to the arbitration committee, and the court will make its decision based on the new evidence materials submitted by both parties, inevitably leading to the inconsistency of the first instance judgment and arbitral awards.

    商务部驻深圳特派员办事处日前披露,广东自贸区初步方案已经成形,近期将迎来商务部调研组对其进行可行性评估,评估通过后将报送国务院进行审批。

    Shenzhen Commissioner Office of Ministry of Commerce revealed the other day that the preliminary plan of Guangdong Free Trade Zone has been formulated, the feasibility of which will be assessed soon by the research group of the Ministry of Commerce. The result of such assessment will be submitted to the State Council for approval.

    2013年深圳市人才安居试点企业名录日前公布,共有2297家企业入围。预计到今年年底,市级人才安居试点企业约3500家,市、区(新区)试点企业将达到7000家左右,可惠及近20万人才。

    In 2013, the list of Shenzhen’s enterprises for experimental implementation of housing policies for talents was published recently, encompassing 2297 enterprises. It is estimated that to the end of this year, the number of enterprises at municipal level for experimental implementation of housing policies for talents will reach 3500, and the number at district (new district) level will reach around 7000, covering nearly 200000 talents.

    Beijing: dust-raising and polluting enterprise will pay cash deposit from the next year

    北京市环保局近日发布“清洁空气行动计划任务分解”,首次提出扬尘污染保证金制度,要求在今年年底前起草施工扬尘污染防治保证金制度实施方案,2014年1月发布实施。

    Beijing Environmental Protection Agency recently released the Breakdown of Task of Atmosphere-Cleaning Action Plan, proposing for the first time the system of imposing cash deposit on the pollution of dust. It required the implementation plan of the cash deposit system for the pollution of construction dust should be drafted prior to the end of this year, which would be published and implemented as of Jan. 2014.
