浅析《劳务派遣管理规定》(征求意见稿)

Analysis on the administrative rule on labor dispatch (draft soliciting comments)

《规定》也不是完美的,虽然明确了诸多问题,但对派遣比例严格限制在10%,且无过渡期,这似乎没有考虑到实际操作的可行性,极有可能引发群体性事件。

The Rule is not perfect, although it specifies above mentioned questions, it strictly restricts the percentage of labor dispatch to 10% and no transition period is allowed. This seems not having considered the practicability and easy to cause collective events.

    商务部、外交部、公安部等九部门日前发布关于印发《对外投资合作和对外贸易领域不良信用记录试行办法》的通知,规定在对外经济合作领域和对外贸易领域如有企业有违反《办法》中相关规定的行为,将被列入不良信用记录“黑名单”。

    Nine ministries and departments including the Ministry of Commerce, the Ministry of Foreign Affairs and the Ministry of Public Security recently issued a notice on the Trial Regulation of Record of Adverse Credit in Foreign Investment and Cooperation and Foreign Trade, stipulating that if any enterprise in the field of foreign economic cooperation and foreign trade commits any act specified in the Regulation, such enterprise will be blacklisted on the record of adverse credit.

    Guangdong released the salary guideline for enterprise in 2013

    广东省人社厅日前发出《关于公布广东省2013年企业工资指导线的通知》,提出广东企业今年调整工资的工资指导线基准线为10.5%,上线(警戒线)为16%,下线为4%。

    The Department of Human Resources and Social Security of Guangdong Province recently issued a Notice on Releasing Guangdong’s Salary Guideline for Enterprise in 2013, proposing to adjust the benchmark of Guangdong enterprise’s salary guideline of this year to 10.5%, with its up limit (warning line) of 16% and down limit of 4%.

    Shanghai Pilot Free Trade Zone will be formally established at the end of September

    据悉,上海自贸区将于9月29日正式挂牌启动,同时其总体方案也公布在即。总体方案或将涉及98项试点项目,具体落实到各职能部门负责推进。

    It is said that Shanghai Pilot Free Trade Zone will be formally launched and established on Sept. 29th, and its overall plan will be released soon. This plan may involve 98 pilot projects, which will be taken over and promoted by various functional departments.

    Beijing: part of employees are asked to supplement social security contribution

    北京市人社局透露,随着2012年本市职工平均工资的出炉,部分人员需要补缴社保基数差额。其中包括缴费基数低于2013年社保下限、高于2012年上限14016元的在职员工。

    The Human Resources and Social Security Bureau of Beijing stated recently that as the release of the employee’s average salary of this city in 2012, part of employees should supplement their social security contribution, including those whose base of contribution is less than the lower limit of 2013 and higher than the upper limit of 2012, i.e. 14016 yuan.

    2013年第四季度“中欧-博尔捷招聘指数”显示,经历了第三季度招聘指数的明显回落之后,本季度预期招聘需求出现轻微反弹。新季度全国综合招聘指数为+1.28%,与上季度(+1.19%)相比,环比微弱回升7个百分点。

    China Europe-Bridge Help-Wanted Index of 4th Quarter of 2013 shows that the index experiences a slight rebound this quarter after the significant fall in the 3rd. In this new quarter, the national comprehensive help-wanted index is +1.28%, growing by 7 percentage point compared with last quarter’s number (+1.19%).

    A global survey made by Padersen Partners, a head-hunting company, shows that the average annual income of top management of global enterprise with over 100000 employees is 1.35 million Euro. Compared with the previous year, the basic remuneration increases by 5.5% and the total remuneration, which includes bonus, increases by 3.4%.

    智联招聘推出2013年秋季跳槽特别调查显示,20.8%的白领表示已经完成了跳槽。还有三成白领表示自己已经开始通过招聘网站、熟人介绍等形式开始寻找新的工作机会。仅有11.6%的白领明确表示压根没有跳槽的打算。

    A special survey of job hopping carried out by Zhaopin in the fall of 2013 shows that 20.8% of white-collar workers have completed job hopping, and 30% of them have begun to seek new work opportunities through recruitment websites and acquaintances. Only 11.6% of white-collar workers do not intend to change job.

    Hu Xiaoyi, Vice Minister of the Ministry of Human Resources and Social Security indicated recently that 0.78 billion people in our nation had enjoyed basic endowment insurance as of the end of the last year. By 2020, the rate of coverage of our nation’s urban and rural basic endowment insurance will be increased to 95%, which means around 200 million people will be added to its coverage in the next 8 years.
