违反计划生育政策的女职工是否还享有产假?

Is the female employee violating the family planning policy still qualified for maternity leave?

无论女职工是否违反计划生育政策,享受产假休息是法定权利。但是,《劳动法》并未对产假待遇做出规定。

Maternity leave is a statutory right of female employee irrespective of her observance of family planning policy. Nevertheless, the Labor Law fails to give any stipulation regarding the benefit of maternity leave.

    Social Health Insurance Scheme in Shenzhen has been published in the latest Government Gazette. According to this Scheme, if the employing unit has invested in a basic medical insurance for the migrant workers, the migrant workers will enjoy the same medical insurance scheme with the household workers. The new Scheme will be implemented since January 1st, 2014.

    广东省人大日前对《广东省失业保险条例(修订草案修改稿)》进行评估,按照草案内容,失业人员在领取失业保险金的同时,或可同时领取求职补贴,标准为本人失业前12个月平均缴费工资的15%,领取期限最长不超过6个月。

    The People’s Congress in Guangdong Province has recently given assessment to the Unemployment Insurance Regulations in Guangdong Province (Revised Amendment Draft). According to the Content of the Draft, the unemployed may, at receiving the unemployment insurance fund, simultaneously receive job-hunting subsidies. The standard is 15% of the average wage payment in the 12 months prior to the unemployment. The length of receiving the salary should be no more than 6 months.

    广州市地税局近日重申,工伤获得的医疗补助金、住院伙食补助费等待遇不需缴纳个税。

    The Local Tax Bureau in Guangzhou City has recently reiterated that medical subsidies and hospital food subsidies received from work-related injuries should not be required to pay individual tax.
