招聘时双方应如何履行告知义务?

How can the employing unit and employee fulfill their respective notification obligations during recruitment?

告知的方式,法律并未规定,可以是口头,也可以是书面,但为了避免争议,也是为了取证留档,应以书面告知为主。

The law does not have any provisions on the form of notification. It can be done in writing or orally. However, to avoid disputes or for the sake of proofing, the notification should be done in writing.

  • 在劳动合同履行过程中,对于劳动者占有单位价值较高的财物,单位为防止财物灭失或被轻易毁坏,与劳动者约定设置了相应的合理担保的,法律没有禁止,可以认定有效。
  • During the labor contract fulfillment process, if the employee needs to occupy property of the employing unit with relatively high values while the employing unit agrees on corresponding reasonable guarantee with the employee in order to prevent losses of and damages to the property, as the law does not prohibit such an agreement, it shall be deemed as valid.

  • 城乡保转入职工保只转账户不计年限

    Payment years will not be calculated when transferring account from urban and rural endowment insurance to employee pension system

    《城乡养老保险制度衔接暂行办法》7月1日起施行。办法明确从城乡居民养老保险转入城镇职工养老保险时只转个人账户不计算缴费年限,而从城镇职工养老保险转入城乡居民养老保险时个人账户和缴费年限都能转入和计算。

    The Interim Regulation on Transition of Urban and Rural Endowment Insurance will be implemented from July 1st. In this regulation, it is clearly stipulated that payment years will not be calculated when transferring personal account from urban and rural endowment insurance to urban employee pension system, while such payment years will be calculated when transferring personal account from urban employee pension system to urban and rural endowment insurance.

    The Ministry of Human Resources and Social Security says the time of retirement may be formally postponed as of 2020

    有消息称,人力资源和社会保障部对延迟退休政策推行的时间,以及延迟方案,已有初步的设计:有可能在“十二五”后期出台政策,“十三五”期间作相关准备工作,并在2020年左右开始正式实施。

    It is said that the Ministry of Human Resources and Social Security has made an initial decision on the time and plan of postponing retirement. Related policies may be introduced in the late 12th Five-Year Plan period, and its preparatory work will be fulfilled in the 13th Five-Year Plan period. The time of retirement will be formally postponed from around 2020.

    Mr. Hu Xiaoyi, Deputy Minister of the Ministry of Human Resources and Social Security said recently that the income from the investment of pension balance was unsatisfactory due to the restriction of investment channel. The Ministry was studying the issue of investment and operation. however, there has been no specific schedule for developing a relevant plan by now.

    Guangdong's shortage of manpower after Spring Festival reaches around 800 thousand

    据广东省人力资源市场和企业用工监测显示,节后企业员工返岗率(包括本省和外省员工)为92.2%,同比提高2.8个百分点。截至2月26日,全省用工缺口约为60-80万人。

    According to a survey of Guangdong Human Resources Market and enterprise's labor force, the rate of employee's return to work (including those employees from Guangdong and other provinces) after Spring Festival is 92.2%, increasing by 2.8% year on year. As of Feb. 26th, the shortage of manpower in Guangdong is about 600 to 800 thousand.

    Beijing: the monthly allowance for employee suffering from work-related injury is increased by up to 360 yuan

    北京市人力资源社会保障局日前公布工伤职工津贴的最新标准,一至四级工伤职工伤残津贴根据伤残等级每人每月分别增加360元至300元不等。

    Beijing Human Resources and Social Security Bureau has released the latest standards of the monthly allowance for employee suffering from work-related injury, which is increased by 300 to 360 yuan monthly for those employees suffering from level 1 to level 4 work-related injuries.

    发改委近日表示,中国2014年计划城镇新增就业人口1000万人以上,城镇登记失业率控制在4.6%以内。

    According to a message revealed by the NDRC, in 2014, the number of the newly-added labor force in urban area is planed to exceed 10 million, and the registered unemployment rate in urban area will be controlled under 4.6%.
