“医疗期满”的解雇需要注意哪些?

What should be noted in dismissing employees upon the expiration of the medical treatment period?

对于医疗期满解雇的规定,法律有两个要求,一是医疗期满;二是不能从事原工作也不能从事另行安排的工作。

The law has mandated two requirements for the termination on the ground of expiation of medical treatment period: 1) the medical treatment period has expired; and 2) the employee cannot qualify for his original post or another post separately assigned.

    Employees of Public Institution Establishment Contribute Social Insurance from July Onwards

    国务院日前发布的《事业单位人事管理条例》规定,事业单位及其工作人员依法参加社会保险,工作人员依法享受社会保险待遇。该条例将于7月1日起正式实施。

    The State Council has recently promulgated the Regulations on the Human Resources Management of Public Institutions, stating that public institutions and their employees should contribute social insurance and enjoy social insurance treatments in accordance with law. The Regulations hereof will be officially enacted on July 1.

    Ministry of Commerce: Loosing Access Threshold for Foreign Investments

    商务部日前发出《关于改进外资审核管理工作的通知》,明确除法律、行政法规以及国务院决定对特定行业注册资本最低限额另有规定外,取消外商投资公司最低注册资本的限制。

    The Notice on Improving the Management of Foreign Investment Approval recently released by the Ministry of Commerce expressly stipulates that, except that the law, administrative regulations and the State Council have set minimum amount for registered capital in some special industries, limitations on the minimum amount of registered capital by foreign companies are hereby lifted.

    Guangdong: Another Contribution of RMB 20 per Year Can Cover 70% of Self-paid Part in Medical Insurance

    广东省总工会今年拟投3100万元推“住院二次医保”。职工只需缴费95元,(省总工会负担75元,员工自付20元)就可以在一年的保障期内因病住院时,享受基本医疗保险自付部分70%的“二次报销”。

    Guangdong Provincial Federation of Trade Unions intends to introduce "second-time medical insurance for hospitalization" with an investment amount of RMB 31 million. With a contribution of RMB 95 (RMB 75 from the Federation and RMB 20 from the worker), the worker can enjoy "second-time reimbursement" at 70% for the self-paid part of illness-based hospitalization costs in the basic medical insurance within the one-year insurance period.

    Shenzhen: Balance of Medical Insurance Can Be Used in Fitness Consumption if Exceeding RMB 5000

    最近审议的《深圳经济特区促进全民健身条例草案修改一稿》明确,市民的医疗保险个人账户上年度余额达到5000元以上的,可以将余额的10%用于个人健身消费。

    Pursuant to the First Revision for the Regulations of Shenzhen Special Economic Zone on Promoting Nationwide Fitness (Draft) which has been under deliberation recently, where the balance of medical insurance personal account from the previous year exceeds RMB 5000, 10% of the balance can be used for personal fitness consumptions.

    Beijing: Routine Adjustment of Issuance Standards for Loans from Housing Provident Fund

    北京住房公积金管理中心发布消息,从7月1日起,对购买第二套住房的贷款发放对象,由仅限于现有人均住房建筑面积低于29.4平方米(不含)的缴存职工家庭,提高至低于31.31平方米(不含)的缴存职工家庭。

    According to the recent news of Beijing Housing Provident Fund Management Center, since July 1 onwards, households with a per capita floor area less than 31.31 m2 (excluding) are entitled to loans from housing provident fund for their purchase of a second house, increasing from previous 29.4 m2 (excluding).

    The China Talent Trend Report 2014 recently released by LinkedIn shows that, 21% of the surveyed are actively seeking for their next job, while 53% are willing to contact with headcounters and discuss alternate career opportunities.     According to statistics, 12 provinces and municipalities directly under the central government, including Chongqing, Shaanxi, Shenzhen, Shandong, Beijing, Shanghai, Tianjin, Shanxi, Gansu, Qinghai, Yunnan, Sichuan, have raised minimum wage in the first half of 2014, with an average increase of around 14%.

    深圳市社保局透露,7月1日起,深圳市社会保险缴费基数和待遇偿付基数有调整,涉及该市上年度在岗职工月平均工资的,均按5218元/月的标准计算。

    Shenzhen Municipal Human Resources and Social Insurance Bureau reveals that the social insurance contribution base and treatment and reimbursement base of Shenzhen will be adjusted from July 1. For all matters that involve average monthly salary of on-the-job workers in the first half of the year, the base is subject to RMB 5218/month.

    劳动报网站近日发布的《IT行业程序员收入趋势调查报告》显示,有近8成的程序员月薪在5000元-1.5万元这一区间。受访者的月薪平均数为10950元。

    According to the Report on the Remuneration Trend of IT Programmers published on www.labour-daily.cn, nearly 80% of the surveyed programmers have a salary within RMB 5000-15,000, with the average monthly salary at RMB 10950.
