用人单位如何处理与退休相关的员工关系

How to handle relationship with employees reaching official retirement age

对于已达退休年龄,且用人单位与其已解除劳动关系,但因劳动者社会保险费缴费年限不够,不能享受养老保险待遇的,劳动者再就业与用工单位发生争议的,按劳务关系处理比较恰当。

As for cases which involve employees who have reached retirement age but are not entitled to endowment insurance benefit due to insufficient contribution years for the social insurance, if any disputes arise when the employees find a new job, we are in the opinion that the case shall be handled as a civil dispute case between the employee and the new employer.

    The China Employment Training Technical Instruction Center (CETTIC) of the Ministry of Human Resources and Social Security (MOHRSS) recently announced that it would add 6 CETTIC vocational certificates this year, including food information security member, food safety coordinator, Montessori trainer, VIP service provider, sub-health consultant, and child health consultant.

    人力资源和社会保障部副部长胡晓义近日在全民参保登记计划试点工作视频会议上说,该计划2014年在全国部分地区启动试点,2015年完善方案和措施,将试点扩大到50%左右的地区。

    Hu Xiaoyi, Vice Minister of the Ministry of Human Resources and Social Security (MOHRSS) said on a videoconference regarding pilot work for the universal insurance registration program that the program would be piloted in some regions in 2014. In 2015, the program would be further improved and relevant measures would be adopted to expand the program to more than 50% regions in China.

    北京市安全生产监督管理局等八部门近日出台推进企业安全生产的一系列激励政策,将企业安全生产标准化与企业信用管理、工伤保险费率、信贷、政策支持、污染企业调整退出相结合。

    Beijing Administration of Work Safety, together with seven other departments, recently promulgated a series of incentive policies to promote safe production. These policies link an enterprise's safe production standardization with its credit management, work-related injury insurance premium, credit support, policy support, and adjustment and withdrawal of polluting enterprises.

    Guangzhou: 90% of Contributors Failed to Enjoy Befits from House Purchase with Housing Provident Fund

    据广州市住房公积金管理中心的数据显示,截至2013年年底,累计接近800亿元的贷款总额仅发放给了9%不到10%的贷款人,也就说,90%的缴存人未享受到公积金所带来的购房实惠。

    According to data of Guangzhou Housing Provident Fund Management Center, as at the end of 2013, cumulatively about RMB 80 million of housing provident fund loans were released, but only to over 9% but less than 10% contributors. That is to say, nearly 90% of contributors did not enjoy benefits brought by house purchase with housing provident fund.

    湖南省直住房公积金管理中日前发布了《关于进一步规范重大疾病提取住房公积金相关事项的通知》,明确“重大疾病”提取公积金的九种疾病类别以及相关的申请手续。

    Hunan Provincial Housing Provident Fund Management Center recently promulgated the Notice on Further Regulating Matters Relating to the Withdrawal of Housing Provident Fund in the case of Major Diseases. The document expressly specifies the 9 types of "major diseases" under which the housing provident fund can be withdrawn and relevant application procedures.

    从7月起,广州2014年度职工个人住房公积金“免税线”由此前的15939元上调至17424元,职工每月可缴纳公积金最高额度为11616元,其中最高免税额为4182元(包括个人及单位两部分)。

    From July onwards, the "tax exemption line" for housing provident fund of workers in Guangzhou in 2014 is adjusted to RMB 17424 from the previous RMB 15939. The cap amount for a worker's monthly housing provident fund contribution is RMB 11616, up to RMB 4182 (including parts contributed by both the worker himself and his employing unit) of which can be tax free.

    Zhaopin.com recently released the Industry Recruitment Supply and Demand Report 2013. According to the report, private enterprises provided 68.0% jobs in all sectors in 2013, followed by joint-stock companies at 11.7%. State-owned enterprises and joint ventures only contributed 8.1% and 4.9% respectively.

    Microsoft recently announced that it will lay off 18,000 workers in the following year, 12,500 from the Nokia division. As to China Region, the Nokia plant located in Beijing Economic and Technological Development Zone will be evacuated from Beijing within the year, involving 3000 people.
